Terms of Service
These Terms govern your use of hometownreply.com and the Hometown Reply text messaging service, provided by Hometown Reply ("Hometown Reply", "we", "us"). By using the website, signing up as a client, or taking part in our SMS program, you agree to these Terms and to our Privacy Policy.
1. SMS program terms
Program description: Hometown Reply sends text messages on behalf of local service businesses. These include replies to missed calls, questions about your service request, appointment confirmations and reminders, arrival notices, and review requests. People who request a demo and opt in on our website may also get texts about that request.
How you opt in: by calling or texting a participating business and receiving a reply, booking a service and agreeing to reminders, or checking the SMS consent box on a form. Consent is not a condition of purchase.
Message frequency varies. Msg & data rates may apply.
Reply STOP to opt out, HELP for help. After you text STOP you'll get one confirmation message and no further messages from that number unless you reply START. For help, reply HELP or contact [email protected] / (470) 354-6032.
Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed.
Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Opt-in data and consent will not be shared with any third parties. See our Privacy Policy.
2. Client service terms
- Plans and fees. Clients pay a one-time setup fee and a monthly fee for their chosen plan, as quoted in writing. Published prices are starting prices. Plans include a fair-use message allowance, and usage above it is billed as agreed.
- Term and cancellation. Service is month-to-month. Either party may cancel with [NOTICE PERIOD, e.g. 30 days'] written notice. Setup fees aren't refundable once carrier registration is filed, unless agreed otherwise in writing.
- Setup timing. Texting starts only after carrier (A2P 10DLC) registration is approved. This usually takes 2-3 weeks but is controlled by third parties, so we can't guarantee it.
- Client responsibilities. Clients must give accurate business information for registration, text only people who contacted them or are their customers, never use the service for unsolicited marketing, honor opt-outs, and follow applicable law, including the TCPA and carrier rules. Clients may not ask us to filter review requests so that only happy customers receive them.
- Phone numbers. Clients keep their existing business numbers. Any text-enabled number we provision stays tied to the service while it is active. [Describe porting/transfer terms.]
3. Acceptable use
You may not use the website or service to send spam, or illegal, harassing or deceptive content, or content prohibited by carriers (for example SHAFT content: sex, hate, alcohol, firearms, tobacco, where restricted). You also may not interfere with the service.
4. Disclaimers
The website, the interactive demo and the ROI calculator are for illustration only. Demo conversations and calculator defaults are example data and do not promise any result. The service is provided "as is". To the extent permitted by law, we disclaim implied warranties. Text messages depend on carriers and third-party providers, and delivery can be delayed or fail.
5. Limitation of liability
To the extent permitted by law, our total liability for any claim relating to the service is limited to the fees the Client paid us in the [3] months before the claim. We are not liable for lost profits or indirect damages.
6. Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Venue: Hall County, Georgia.
